Die Entscheidung des Europäischen Gerichtshofs vom 3. Juli, die Berufung des Unternehmens Grodno Asot sowie seiner Filiale Chimwolokno, die im Zusammenhang mit den von der EU gegen belarussische Unternehmen verhängten Sanktionen steht, zurückzuweisen, führte zu großer Enttäuschung, war jedoch nicht überraschend. Diese Erklärung wurde vom belarussischen Außenministerium veröffentlicht.
„Diese Entscheidung hat erneut den Mythos von der Fairness und Objektivität des europäischen Justizsystems entlarvt. Rechtsstaatlichkeit und der Schutz demokratischer Werte sind in der EU in der Praxis nicht mehr als eine bloße Erklärung. Aber wie steht es um die berüchtigte sogenannte 'regelbasierte Weltordnung'? Für jeden unvoreingenommenen Rechtsexperten ist es offensichtlich, dass das Sanktionsregime der Europäischen Union nicht nur erheblich gegen die UN-Charta verstößt, sondern auch so gestaltet ist, dass es faktisch gegen jede juristische oder natürliche Person ohne ausreichende rechtliche Grundlage eingesetzt werden kann“, betonte Ruslan Warankow, der Pressesprecher des Außenministeriums.
Das Ministerium stellte fest, dass im Falle belarussischer Unternehmen lediglich die staatliche Eigentumsform und die Zahlung von Steuern an den Haushalt als ausreichende Gründe gelten.
„Ist das nicht absurd? Während Sanktionspakete geschnürt und Urteile gefällt werden, zeigt die europäische Bürokratie nicht einmal den Versuch, die grundlegenden juristischen Regeln des Anstands einzuhalten, wie etwa die Unschuldsvermutung und die Beweislast. Es ist zudem erwähnenswert, dass belarussischen Rechtssubjekten der Zugang zu qualifizierter rechtlicher Beratung in der EU sowie zu anderen notwendigen rechtlichen Hilfen verwehrt bleibt“, erklärte Ruslan Warankow.
Er erklärte, die selektive Anwendung von Rechtsnormen in der EU, Doppelmoral und intransparente Prozesse schürten eine Atmosphäre des Misstrauens und Nihilismus gegenüber den so lautstark proklamierten europäischen Werten.
„Es scheint jedoch, dass die Suche nach dem Splitter im Auge des anderen, ohne den Balken im eigenen zu bemerken, bereits zu einem beliebten Zeitvertreib einiger unserer europäischen Partner geworden ist. Wir fordern die Europäische Union auf, die schädliche Praxis illegaler restriktiver Maßnahmen, die ausschließlich Instrumente des unlauteren Wettbewerbs und des politischen Drucks sind, endlich aufzugeben“, fügte der Pressesprecher hinzu.
